Terms of Service

These Terms of Service govern your access to and use of afterblink.co, including the self-service diagnostic assessments offered through the site and any related services (collectively, the “Service”). The Service is operated by The Afterblink Company, LLC (d/b/a afterblink.co), and references to afterblink.co in these Terms mean that entity. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Acceptance of Terms

By creating an account, taking an assessment, subscribing to the newsletter, or otherwise using the Service, you confirm that you have read and agree to these Terms and the Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and references to “you” in these Terms include that organization.

The Service

afterblink.co is an editorial marketing advisory company that provides a suite of self-service diagnostic assessments designed for senior marketing leaders in mid-market organizations. Each assessment produces a structured report describing where your organization stands across the capabilities that assessment measures and, where applicable, the archetype that best characterizes its current operating pattern. afterblink.co may add, modify, suspend, or discontinue any assessment or any part of the Service at any time without notice.

Eligibility

You must be at least eighteen years old to use the Service. The Service is not directed to individuals under eighteen, and afterblink.codoes not knowingly collect information from them. By using the Service, you represent that you meet this requirement.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to update that information if it changes. If you suspect unauthorized use of your account, notify afterblink.copromptly. afterblink.co is not liable for losses resulting from unauthorized access to your account caused by your failure to safeguard your credentials.

Acceptable Use

You agree not to use the Service to violate any applicable law or regulation; to infringe the intellectual property or other rights of any third party; to reverse engineer, decompile, or attempt to derive the source of any part of the Service; to interfere with or disrupt the integrity, performance, or security of the Service; to use automated systems to access the Service without express written permission, except for public, well-behaved crawlers that respect robots.txt; to resell, sublicense, or otherwise commercially exploit the Service or its output without express written permission; or to generate assessment results or reports on behalf of parties other than the organization to which your account relates.

The Assessments and Your Reports

The assessments are editorial diagnostic instruments. Each assessment and the resulting report are provided for informational purposes and reflect the company’s point of view. They do not constitute professional advice and are not a substitute for engagement with a qualified advisor in your jurisdiction.afterblink.co makes no representation that any report will produce any particular outcome if acted upon.

afterblink.co retains all rights in the assessment instruments, the archetype frameworks, the scoring methodologies, and any aggregate or derivative analyses produced from assessment data. Your reports are made available to you for your own use within your organization and may be shared internally with colleagues and advisors on a need-to-know basis. You may also share a report using the Service’s own share-link feature; anyone holding a share link can view that report while the link is live, and share links expire after thirty days and can be revoked at any time. Outside of that feature, you may not republish a report, resell it, or use it as the basis for products or services offered to third parties without express written permission.

Intellectual Property

All content on afterblink.co, including the assessment instruments, the archetype frameworks, the scoring methodologies, written materials, visual design, and the site’s codebase, is the property of afterblink.co or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited rights granted to you in these Terms, no rights are transferred to you by your use of the Service.

The afterblink.co name, logo, and any related marks are trademarks ofafterblink.co. You may not use these marks without prior written permission.

Disclaimers

The Service is provided “as is” and “as available,” without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, timely, secure, or error-free. afterblink.co does not warrant that any information provided through the Service is accurate, complete, reliable, or suitable for your purposes. You use the Service at your own discretion and risk.

Limitation of Liability

To the fullest extent permitted by applicable law, afterblink.co and its principals, agents, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, business opportunity, or goodwill, arising out of or in connection with your use of the Service, whether based on contract, tort, strict liability, or any other legal theory, and whether or not afterblink.co has been advised of the possibility of such damages.

In no event will the aggregate liability of afterblink.co to you for any claim arising out of or in connection with the Service exceed the greater of one hundred United States dollars or the amount you have paid to afterblink.co in the twelve months preceding the claim.

Termination

afterblink.co may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting afterblink.co at the address below. Upon termination, your right to use the Service ceases immediately; provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and governing law, will continue in effect.

Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

afterblink.co may update these Terms from time to time. When a material change is made, the “Last updated” date at the top of this page will be revised, and where appropriate, afterblink.cowill provide additional notice through the Service or by email. Your continued use of the Service after a change becomes effective constitutes acceptance of the revised Terms.
